Collaborative Divorce: Hoe Een Teambenadering in Conflictoplossingsprocessen Tot Een Succes Maken? (Collaborative Divorce: How to Make a Team Approach to Conflict Resolution a Success?)

Abstract

Collaborative divorce is sinds 2009 in Nederland op steeds bredere schaal ‘te verkrijgen’. Wat nu moet blijken is of het een aanpak is waarin vertrouwen verder groeit, welke op waarde wordt geschat, en door toenemende gebruik een volwaardige plek in het palet aan geschiloplossingsmethoden gaat innemen. Ofwel: wordt het the-next-big-thing na mediation en groeit dit veelbelovende concept succesvol, verantwoord en duurzaam door in de Nederlandse (echtscheidings)praktijk?

Wij gaan op zoek naar wat nodig lijkt om deze vorm tot een echte ‘hit’ te maken, zoals het dat in sommige Anglo-Amerikaanse landen al is. Onze focus is het unieke van deze vorm, namelijk het samenspel van een team van betrokkenen en partijen, dat met het doel samen tot adequate, duurzame oplossingen voor partijen te komen. Doel van ons stuk is om bij te dragen aan genoemde verdieping en verankering van collaborative divorce en om zowel voor gebruikers als vooral ook voor de professionals handvatten te bieden om collaborative divorce stevig neer te zetten. Door een meer systematische aanpak van collaborative divorce kan deze vorm van conflictbeslechting een volwaardige loot aan de stam van de scheidingsboom worden.

The past decades a number of innovations in lawyering were introduced. Collaborative divorce is a relatively new one. Collaborative lawyers commit to helping to resolve disputes for their clients by negotiating instead of litigating. This lawyering and dispute resolution approach that started in the U.S. is developing in other countries as well, particularly in the field of family law. The Netherlands is one of those countries. It got introduced there in 2009. Now, in 2012, its no longer the new kid on the block. In order to establish itself among other dispute resolution methods it is time it starts to live up to its full potential. This article (written in Dutch) explores how it may best proof itself as an attractive alternative in the Netherlands, keeping in mind experiences with the introduction and (slow) growth of mediation in the Netherlands one and a half decades ago. We discuss some of the main success and fail-factors when introducing new lawyering and dispute resolution methods, than focus on the challenges and opportunities for collaborative divorce, and finally try to offer collaborative professionals some guidelines in how to best grow their practice. We particularly look at the opportunities and pitfalls of the ‘team approach’ that make this form stand out from other approaches. We draw lessons from the experiences in the U.S. and Canada and from theory on successfully organizing team efforts.
