Abstract

Este artículo analiza las novedades principales que se introdujeron en la ley española de arbitraje por medio de la Ley 11/2011.

The Spanish Arbitration Act (Ley 60/2003, de 23 de diciembre, de Arbitraje) was amended in 2011 by the Act 11/2011 (Ley 11/2011, de 20 de mayo, de reforma de la Ley 60/2003, de 23 de diciembre, de Arbitraje y de regulacio ́n del arbitraje institucional en la Administración General del Estado). This amendment introduces a new regulation on relevant issues, such as: competence of the courts in arbitration matters, mandatory insurance for arbitrators, arbitration of corporate matters, effect of insolvency proceedings in arbitration agreements, public institutions’ arbitration, action to set aside the award, etc. The paper analyzes these modifications and also reflects on some controversial aspects of the amendment.
