Abstract

In dit preadvies wordt gepoogd enige aspecten van het in België geldende systeem van onroerende en hypothecaire publiciteit op een kritische wijze te belichten. Het betreft de publiciteit in geval van overdracht, overgang of aanwijzing van onroerende zakelijke rechten, alsook de vestiging van zakelijke zekerheden op onroerende goederen, namelijk onroerende voorrechten en hypotheken. Dergelijk systeem van publiciteit vormt een bron van informatie over rechten en lasten betreffende onroerende goederen. Deze informatie speelt een dubbele rol: enerzijds als loutere informatie of databank inzake onroerend vermogen, anderzijds als kerngegeven opdat beweerde rechten inzake onroerende goederen aan derden kunnen worden tegengeworpen.

This paper seeks to highlight several aspects of the current Belgian system of publicity of mortgage and immovables. These publicity includes cases of transfer or designation of immovable real rights and the establishment of priviliges, namely property liens and mortgages. Such a system of publicity is a source of information on duties and charges on real estate. This information plays a dual role: on the one hand as mere information or data relating to real property, on the other hand, as core data that claimed rights to immovable property can be invoked against third parties.
