Indian Case Analysis of Internal Aids to Construction

Abstract

This study has the following main objectives: 1) Understanding of the different kinds of aids to Construction. 2) To examine the various cases with regard to Internal Aids to construction. 3) To find out the existing law on Internal Aids to Construction.

Should internal Aids to construction such as headings, preamble, and proviso be construed to convey the legislative intent? We proceed upon the Hypothesis that internal aids to construction can be very useful in ascertaining the intention of the legislature, and therefore we go forward to test this hypothesis. In this paper we try to find as to how relevant are internal aids to construction, do they signify the intent of the legislators. Also by virtue of case analysis we try to depict the exact scope of internal aids i..e, to what extent were internal aids to construction relied upon by the courts. Analysis of cases provides us with an apt picture of the extent of the doctrine. And by this paper we intend to achieve the goal of stating exactly and authoritatively the significance of Internal Aids to construction.
