Abstract
O presente paper busca analisar a doutrina dos direitos sociais no Brasil. A partir dos textos de Cass Sunstein e Stephen Holmes, The Cost of Rights: Why Liberty Depends on Taxes, intenta-se defender um mínimo existencial à saúde e prestação positiva do Estado. Contudo, debatem-se as reais possibilidades com a doutrina e seus eventuais avanços e retrocessos. Na doutrina brasileira, tenta-se mapear o estado da arte da discussão, fazendo com que autores de diversos campos de trabalho dialoguem na tentativa da real efetivação dos direitos sociais. Ao final, apresentam-se as principais conclusões articuladas para o leitor.
This paper intends to analyze the doctrine of social rights in Brazil. From the writings of Cass Sunstein and Stephen Holmes, "The Cost of Rights: Why Liberty Depends on Taxes", it seeks to defend an existential minimum health and positive provision of the Government. However, the real debate is possible with the doctrine and any advances and setbacks. In the Brazilian doctrine, attempts to map the state of the art of discussion, so that authors of several labor camps in an attempt to hold discussions of the proper enforcement of social rights. In the end, we present the main conclusions articulated to the reader.
