Abstract

Le présent article propose une étude des sources du droit international humanitaire afin d’évaluer la place et le rôle de cette branche si particulière du droit international public. Il analyse le droit des traités, le droit coutumier et le droit impératif pour mieux comprendre les relations denses et complexes unissant le droit international humanitaire et le droit international général. Ce retour aux sources permet ainsi d’identifier les spécificités du droit international humanitaire mais aussi ses points communs avec les autres branches de droit international applicables aux conflits armés, telles que le droit international des réfugiés et le droit international des droits de l’homme.

This article proposes a comprehensive mapping of the primary sources of international humanitarian law. It analyses the respective role of treaty law, customary law and jus cogens in framing this particular branch of law. This overview highlights the complex and numerous interactions between the law of armed conflict and general international law. It further identifies the specificities of international humanitarian law and its common features with other branches of international law, such as human rights law and refugee law.
