Abstract

Italian Abstract: Il lavoro esamina la cedolare secca e l’Imu. Nel reintrodurre la tassazione patrimoniale sulle prime case, l’Imu ha di fatto esentato quelle corrispondenti ai normali fabbisogni della famiglia italiana, tranne che nelle grandi città; l’aggravio sulle altre abitazioni è stato in parte compensato dall’abolizione dell’Irpef sul reddito figurativo; la riforma ha pesato di più sul sistema produttivo. La cedolare secca mirava a far emergere i contratti in nero, che sfuggono alle imposte, ma non tutelano i diritti delle parti in causa, nonché a garantire maggiore neutralità rispetto alla tassazione del risparmio. Le due imposte hanno richiamato sul mercato degli affitti case prima tenute a disposizione, ma hanno ridotto il rendimento netto atteso dell’investimento immobiliare. Alcune possibili correzioni discusse nel lavoro sono: una differenziazione territoriale della franchigia Imu che esenti i diversi valori dei “primi centro metri quadrati”; la concessione a enti e imprese di sgravi con effetto analogo alla cedolare secca per le persone fisiche; la generalizzazione delle detrazioni per gli affitti pagati da chi non possiede alcuna abitazione.

English Abstract: The paper examines the flat-rate rental income tax and the new municipal property tax. The latter, reintroducing the taxation of owner-occupied dwellings, exempted those corresponding to the normal needs of an Italian household, except in large cities. The additional tax burden on other dwellings has been partly offset by the abolition of personal income tax on imputed incomes. The reform has weighed more heavily on business property. The flat-rate tax was designed to counter unregistered or informal leases, which escape taxation but do not protect the rights of the parties, and to ensure greater neutrality with respect to the taxation of savings. The two taxes have brought previously vacant homes back onto the rental market, but they have also reduced the net expected return on real-estate investment. The paper discusses several possible corrections: a geographical differentiation of the amount exempted from the municipal property tax, to take account of the different values of the "standard dwelling"; tax reliefs for firms and entities similar in effect to that of the flat-rate property income tax for natural persons; tax credits for rents paid by persons who do not own a dwelling.
