Abstract

In an attempt to ensure more consistent results, the Crown Prosecution Service is now responsible for the prosecution process in England and Wales. Prosecution disclosure practice varies depending on a number of factors which the article outlines. A more informal system of pre-trial reviews has also developed in some areas, allowing issues to be identified and also allowing some advance disclosure. The defence does not have the same responsibility in regard to disclosure, and there is evidence of a general shift towards a more inquisitorial process. Abstract by Rose Goss.
