Abstract

The monograph is devoted to key issues on international investment contracts concluded between a host state as a bearer of power and a foreign investor for a specified period and aimed to contribute capital (investment) into the economy of that state. The only type of such agreements referred to in the Russian legislation is a production sharing agreement. Other contracts (concession contracts and service contracts) are considered only on the theoretical level.

The book reveals constitutive features of international investment agreements. It is shown that such contracts regulate not only private law, but also public law relationships, so that they are complex (borderline phenomenon). They should be classified on the legal and economic criteria for concession agreements, production sharing agreements and service contracts. The author examines the legal content of such agreements, determines essential terms among others and defines a list of substantial violations of international investment agreements, which must be fixed mandatory in the legislation of the Russian Federation.
