Deciphering Catalyst to Stimulate Snail Paced Justice: A Multivariate Analysis of Capital Punishment

Abstract

Capital punishment is one of the most debated issues around the world. The UN General Assembly recognizes that in case of capital punishment there is a need for high standard of fair trial to be followed by every country. Procedures to be followed must be just, fair and reasonable.The main aim of Judiciary in 21st century is to make justice speedy and easily accessible to the common people. People by and large have lost their confidence in judicial administration due to inordinate delay in dispensation of justice. Final verdict in criminal cases have become a matter of an unresolved mystery. There is a necessity of an opaque line between the criminology and its interdisciplinary approach so that we can evacuate ourselves from the phobia of rarest of the rare cases. Modes of Commission of an offence are the brainchild of human mind. Hence, it is essential to analyze the crime under certain parameter. It has become necessary to examine the relevance and legitimacy of death penalty in India through judicial pronouncement. We have to realise that Criminals are very much part of our society and we have to reform and correct them and make them sober citizens. Social attitude also needs to change towards the deviants so that they do enjoy some rights as normal citizens though within certain circumscribed limits or under reasonable restrictions.

This Paper deeply concern the paradigm shift in the nature of determining capital punishment i.e from Judge - Centric to Society - Centric.
