Abstract

Spanish Abstract: En este artículo se presenta el proceso de construcción del mercado interior a partir del análisis de las tres Directivas comunitarias que lo han impulsado. Para las dos primeras - Directiva 96/92 EC y Directiva 03/54 EC - se describe la situación del sector anterior a su promulgación, se analiza el contenido de cada una de ellas y, finalmente, se presentan los resultados de su aplicación Por razones obvias, de la tercera Directiva y de los Reglamentos que la acompañan - Directiva 09/72 EC y Reglamentos 714 y 715 de 2009 - sólo se presenta su contenido y se formulan algunas conjeturas sobre los resultados esperados. Antes de abordar las Directivas se hace una pequeña descripción de la Unión Europea, sus instituciones y su normativa y una descripción, igualmente breve, del sector eléctrico europeo entre la segunda postguerra mundial y los años 80. La primera permitirá entender el contexto de la construcción del mercado interior de electricidad y la segunda pondrá de manifiesto que algunas de las dificultades que aún enfrenta el proceso tienen su origen en la institucionalidad sectorial configurada después de la segunda guerra mundial.

English Abstract: This article describes the process of building the internal market from the analysis of the three EU directives that have driven it. For the first two - Directive 96/92 EC and Directive 03/ 54 EC - it is described the sector's situation before its enactment, the content of each is analyzed and finally the results of its application are presented. For obvious reasons, from the third Directive and the accompanying Regulations - Directive 09/ 72 EC and Rules 714 and 715 of 2009 - its only presented their content and some conjectures about the expected results are formulated. Before dealing with the Directives, I make a description of the European Union , its institutions and rules and a description, equally brief, of the European electricity sector between the second world war and the 80's. The first will allow to understand the context of the construction of the internal electricity market and the second will show that some of the difficulties still facing the process are originated in sectoral institutions formed after World War II.
