Abstract

This essay posits the notion that, regardless of whether a case has settled or not at a mediated settlement conference, mediators can (and often should, or sometimes must) continue their engagements after the conclusion of mediated settlement conferences. Acting as a continuing resource for the disputants is considered first when the parties have reached a resolution at the mediated settlement conference. The essay then examines opportunities for continued service when the parties have failed to reach agreement at the conference and even in the face of a declared impasse.
