Rechtsprobleme des Einsatzes von unbemannten 'Kriegsschiffen' (Legal Issues Concerning the Deployment of Unmanned 'Warships')

German Abstract: Im März 2014 verschwand ein Passagierflugzeug von den Radarbildschirmen Malaysias auf dem Weg nach China und gilt als im Ozean verschollen. Nach diesem Flugzeug suchte ein unbemanntes U-Boot namens "Bluefin-21" auf dem Grund des indischen Ozeans. Solche ferngesteuerten und unbemannten Wasserfahrzeuge werden mittlerweile auch eingesetzt, um Piratenangriffe auf Öltanker abzuwehren oder die Küstenwache eines Staates zu unterstützen. Der Rechtsstatus dieser unbemannten Geräte ist jedoch noch nicht abschließend geklärt. Daher zielt dieser Aufsatz darauf ab, eine Übersicht über wesentliche see- und kriegsrechtliche Probleme darzustellen, die durch den Einsatz von unbemannten Wasserfahrzeugen über und unter Wasser entstehen, wenn sie ohne Besatzung und zum Teil bewaffnet die Meere befahren. So wird dargelegt, weshalb es sich bei den sogenannten UNVs um Schiffe und Kriegsschiffe im Hinblick auf relevante internationale Abkommen handelt und welche Auswirkungen ein Kontrollverlust über das Fahrzeug auf dessen Rechtsstatus hat. Hierbei wird auch auf den Rechtsstatus eines gesunkenen Gerätes eingegangen und eine Abgrenzung zu Waffen vorgenommen. Es wird die Bedeutung der Differenzierung zwischen unterschiedlichen Autonomiegraden erläutert und mit dem jeweiligen Rechtsstatus zusammenhängende Rechte und Pflichten angesprochen.

English Abstract: In March 2014 a passenger plane vanished from the radar screens on its way from Malaysia to China. It is believed that the plane crashed into the Indian Ocean, so an Unmanned Underwater Vehicle (UUV) called "Bluefin-21" was deployed to search the ocean floor. These remotely controlled vessels are also used to ward off pirate attacks on oil tankers or to support national coast guards. However, the legal status of these vessels has yet to be resolved conclusively. Therefore, this paper outlines relevant legal issues concerning the Law of the Sea and the Law of Armed Conflict arising from the deployment of unmanned naval vehicles (UNVs) above and below the water, with and without weapons. It discusses why UNVs are ships or warships in relation to international conventions, and which implications loss of control over the vessels has on their legal status. In doing so it elaborates the legal status of a sunken vessel and differentiates between UNVs and weapons. This paper sets out to illustrate the importance of the distinction between certain degrees of autonomy and addresses rights and obligations relating to the legal status on UNVs.
