Waiver of Rights and State Paternalism Under the European Convention on Human Rights Renonciation (aux droits et paternalisme d'Etat dans la Convention européenne des droits de l'Homme)

Abstract

English Abstract: May an individual renounce the rights that he or she is recognized? May a State invoke the waiver of rights by an individual rights-holder, in order to justify its alleged failure to provide adequate protection to that individual? The question of waiver raises fundamental issues concerning the role of human rights in democratic societies -- are they to be conceived as property rights, owned by the individual, or do they fulfil an objective function in the interest of the collectivity itself ? --, as well as the relationship of the State to the exercise of individual freedom -- between the specter of paternalism and the dangers associated with libertarianism --. This paper aims to unpack these various issues, relating them to the case-law of the European Court of Human Rights.

French Abstract: L'individu peut-il renoncer aux droits qui lui sont reconnus? L'Etat peut-il invoquer la renonciation par un individu à son droit, afin de justifier le défaut de protection qui lui est reproché? La question de la renonciation amène des interrogations fondamentales concernant la fonction des droits de l'homme dans les sociétés démocratiques -- doivent-ils être conçus à l'image du droit de propriété, à disposition de l'individu, ou bien remplissent-ils une fonction objective dans l'intérêt de la société dans son ensemble ? --, ainsi que concernant le rapport de l'Etat à l'exercice de la liberté individuelle -- entre le spectre de paternalisme et les risques associés au libertarianisme --. Cet article explore ces problématiques, en les ancrant dans la jurisprudence de la Cour européenne des droits de l'homme.
