Abstract

This chapter provides a comprehensive analysis of Article 5 of the European Union's Charter of Fundamental Rights. Article 5 provides that no one shall be held in slavery or servitude or required to perform forced or compulsory labour and that trafficking in human beings is prohibited. This chapter examines the scope of Article 5 and its interrelationship with the other rights of the Charter, and then analyses each of the aspects of Article 5 with regard to international human rights law instruments and case law, especially from the European Court of Human Rights.
