Abstract

This chapter explores the functions of the criminal courts, explains the adversarial process and introduces the purposes of sentencing. It provides an overview of the specialist courts that have been developed over the past decade in Australia, and includes a discussion of the diversionary practices that have been designed and implemented in an attempt to keep defendants out of the courts altogether wherever possible.
