Abstract

Romanian Abstract: Statul şi autorităţile publice (persoanele juridice de drept public) sunt entităţi juridice distincte de comercianţi, care sunt principalii participanţi în relaţiile comerciale (interne şi internaţionale). Soluţiile legislative sunt diverse, unele legislaţii prevăd expres posibilitatea ca statul să încheie (sau nu) convenţii arbitrale, altele prevăd soluţii intermediare, condiţionând „capacitatea” statului de acordul guvernului; vocaţia statului de a încheia convenţii arbitrale este o chestiune de putere şi mai puţin de capacitate.

English Abstract: State and public authorities (bodies of public law) are legal entities different from traders, the latter being the main participants in (domestic and international) business relationship. Legislative solutions are various, certain legislations provide expressly for the ability of State to conclude (or not) arbitration agreements, while others provide for intermediate formulas, by subjecting the State’s “capacity” to an agreement from government. The State’s ability to conclude arbitration agreements is deemed as an issue pertaining primarily to power, and less to capacity.
