Abstract
This paper takes a closer look at two different approaches to solve problems that digital libraries face when seeking to make their massive content accessible online: the hard law approach in respect of orphan works and the soft law approach in respect of out-of-commerce works. The paper is structured accordingly in two main parts. However, because these frameworks alone are not able to deal with all problems that libraries and other cultural heritage institutions face when seeking to offer access to their collections online the paper, in a third part, addresses one more possible solution that is often advanced in the debate, namely the adoption of a system of extended collective licensing (ECL).
