Abstract

Article 20 of the Statute of the International Criminal Court (ICC) (the 'Rome Statute') contains a ne bis in idem or double jeopardy rule. Ne bis in idem under the Rome Statute is closely connected with the issue of the jurisdiction of the ICC, including the principle of complementarity. This paper provides background information on ne bis in idem in international law and summarises and comments on the individual provisions of Article 20 as well as caselaw from the International Criminal Court on the article, along with their relationship with other provisions of the Rome Statute.
