Abstract
Spanish Abstract: Este trabajo comenta una sentencia dictada por un juzgado de garantía de Arica, la que utiliza erróneamente el Convenio 169 de la OIT al momento de tomar en consideración la relación entre las tradiciones indígenas y la ley penal nacional.
English Abstract: This paper comments on a judgment issued by a Chilean criminal “court of safeguard” (juzgado de garantía). This judgment fails to appropriately use ILO Convention 169 when analyzing the relation between indigenous traditions and domestic criminal law.
