Abstract

The Matrimonial Property Act 1976 represents a complete change in philosophy from previous matrimonial property law. Less discretion has been given to the courts and more power has been given to the statutory scheme. This article goes through the new framework of matrimonial property, explaining the difference between separate and matrimonial property, the general rules around the sharing of property, and remedies that the courts may award.
