Abstract

Vigorous implementation of multiculturalism policy in democratic societies enhances competition between groups for economic resources and political power. This would be the impact of a robust application of 27 of the Charter of Rights and Freedoms, here called “structural pluralism”. The impact of structural pluralism may be moderated by simultaneous application of equality guarantees, as Canadian courts have already illustrated. Application of s. 27 in this strong sense is likely to be most directly relevant to language guarantees. Moderating equality concepts may be less available in this setting without a fully developed theory of equality between groups.
