תקציר בעברית: בעשורים האחרונים התבסס ענף מחקרי העוסק בחקר האושר. ענף זה מבקש לבחון את הגורמים המשיאים את האושר האנושי ועל ידי כך לקדמו. להשאת האושר פוטנציאל השפעה חיובי על היבטי חיים רבים. עם אלו נמנים הצלחה אקדמית ומקצועית, שגשוג אישי ובריאות נפשית ופיזית.

למרות התבססותו של ענף זה ועל אף הרלוונטיות הרבה שלו למשפט, הספרות המשפטית הישראלית אינה עושה בו שימוש מושכל ושיטתי. כך, למשל, הספרות הישראלית העוסקת בחינוך המשפטי אינה מתייחסת כלל לסוגיית אושרם של נמעני החינוך - הסטודנטים. מאמר זה מבקש לייבא עקרונות מתחום חקר האושר וליישמם בחינוך המשפטי.

לביסוס הטענה כי קידום אושרם של הסטודנטים הוא שיקול רלוונטי בעיצוב מדיניות בתי ספר למשפטים נציג הצדקות ערכיות והצדקות תועלתניות. לאחר מכן נציע מגוון אמצעים העשויים להביא להשאת אושרם של סטודנטים. לטענתנו, אמצעים אלו עולים בקנה אחד עם יעדיו המסורתיים של החינוך המשפטי.

English Abstract: Positive psychology seeks to examine the causes of human happiness and ways to promote it. Nowadays, it is known that high levels of happiness have a positive impact on many facets of life. Among these are academic and professional success, quality of life and physical and mental health.

Scientific insights drawn from the field of happiness can be extremely beneficial to lawyers, judges, regulators and policy makers. Indeed, legal scholars have started applying insights drawn from happiness studies to various fields of law. This article seeks to contribute to this growing body of literature by focusing on legal education. More specifically, the article endeavors to re-examine legal education in light of the well-being of law students. We first provide a concise general background to questions such as what constitutes happiness and how it can be measured. Thereafter, we offer utilitarian, ethical and moral justifications for including students’ well-being as a legitimate target of legal education. We proceed to delineate various tools and steps law schools can take to promote students’ well-being.

We argue that such tools and steps are desirable for two principal reasons. The first and more straightforward reason is that law students suffer from low levels of satisfaction and well-being. They are more likely than their peers to suffer from depression, confusion, frustration and disappointment. The second more subtle and challenging reason is that such steps and tools are in line with – and can enhance – the traditional goals of legal education.
