Abstract
תקציר בעברית: אחד השווקים העתיקים, החשובים, הנפוצים והמרגשים בעולם, שוק הפנויים והפנויות, משנה את פניו. אתרי הכרויות מקוונים, לצד פלטפורמות חברתיות מקוונות אחרות, תופסים את מקומם של המוקדים המסורתיים כערוץ הרומנטי המרכזי בעולם הפנויים והפנויות. רשת האינטרנט משנה את פני עולם ההיכרויות, ואתרי ההיכרויות המקוונים הם שדכני העידן החדש.עולם ההיכרויות המקוון מייצר סיטואציות ייחודיות. נורמות חברה, אהבה, רגש, צרכים אנושיים בסיסיים, תקוות, אשליות, נורמות מסחר, ואינטרסים כלכליים כבדי משקל של אתרי ההיכרויות חוברים יחד. חבירה ייחודית זו מציבה אתגרים חשובים בפני המשפט.למרות האתגר המורכב והרב-גוני שמציבים אתרי ההיכרויות בפני המשפט, המחקר המשפטי העוסק בתחום דל. מאמר זה מבקש למלא חלק מהחֶסר בספרות המשפטית בתחום. השאלה המרכזית עליה מבקש המאמר לענות היא כיצד ראוי להסדיר את פעילותם של אתרי היכרויות מקוונים. המאמר מתמודד עם שאלה זו, ומציע עקרונות ראשוניים להסדרת פעילותם של אתרי ההיכרויות תוך התמקדות בהיבטים צרכניים-חוזיים.
English Abstract: One of the oldest, most important and most exciting markets – the dating market – changes rapidly and substantially. The traditional methods for finding love lose much of their appealing and attractiveness. Online dating sites and other online social platforms come to be the main channel for finding love and romance.The online dating world creates unique situations. Cyberspace romance is characterized by the meeting of various forces and multiple interests. It is here that social norms, love, emotions, basic human needs, hopes, illusions, market norms and economic interests all collide. This reality posits special challenges that the law ought to confront.In spite of these challenges, the literature that addresses online dating is partial in scope, under-theorized and under-developed. This article seeks to fill part of this gap. It first examines the market failures and deficiencies that accompany the online dating realm. Thereafter, it suggests novel principles for regulating this market, employing a consumer law perceptive.
