Abstract
Spanish Abstract: Este texto busca responder si es deber del deudor responder por los perjuicios que se generan con ocasión de su incumplimiento, pero que podrían haberse evitado con una conducta razonable del acreedor o la víctima. Para ello se analizan la recepción del llamado deber de mitigar el daño en las distintas familias jurídicas, el panorama actual de la cuestión en Chile y los fundamentos que justifican que se siga avanzando hacia su pleno reconocimiento.
English Abstract: This work analyzes if the debtor should be held liable for the damages resulting from his non-compliance, even if these could have been avoided with the creditor's reasonable behavior. For this purpose, the author examines critically the reception of the Duty to Mitigate in the different legal traditions, the current state of the issue in Chile, and the justifying reasons to advance into the full recognition of this principle.
