Abstract
This paper explores the legal basis for DNA evidence to be considered as a fact. Based on the process and the high risks, many of which cannot be reasonably estimated, the expert opinion based on DNA evidence should be treated with care. Unfortunately, most lawyers and judges believe that this is "clinching" and assume that it "proves" a fact.
