Obergefell, Dignity and the Right to Housing

Abstract
In the recent Affirmatively Furthering Fair Housing Rule, housing is identified as, in fact, dignity. Dignity is established as an individually enforceable right in Obergefell. The Rule fulfills all the requirements, both of Lindsey v. Normet and of West Virginia v. Barnette, for removing housing from the political system and moving it into the Court. That is, the Rule, in conjunction with Obergefell, override Lindsey and establish housing as an individually enforceable right in the United States.
