Preventing Criminal Record Employment Discrimination: Fair Hiring Laws & the Legal Implications of 'Ban the Box' in Florida Laws

Abstract

A person's right to work is the bedrock of the "American dream." However, in our society, people have been denied employment due to past criminal history. Employers don't hire individuals with past criminal history because of various reasons. However, the Equal Employment Opportunity Commission offered guidance to employers about prohibiting the usage of criminal record employment discrimination through Title VII. In response, numerous states have adopted Fair Hiring or "Ban the Box" laws that specifically prohibit criminal record employment discrimination. So far, Florida has not followed this recent trend of adopting any law to prohibit criminal record employment discrimination, while local governments have adopted regulations concerning the topic. Therefore, this Article adopts and proposes a model Fair Hiring Law for Florida.
