Abstract

This Article analyzes the historical evolution of the freedom or right of assembly - with emphasis on its development in England and then in America during the 20th century. This socio-legal study has significance in the 21st century because efforts to seek a balance between individual freedom and social control is of ongoing concern in contemporary society. Stated otherwise, the protection of the public peace must be reconciled carefully with the conflicting interests of allowing free expression of ideas in public places. Today, a reconciliation of these two interests, made reasonably and without arbitrary discrimination, is the norm which the courts must follow in validating the right of assembly.
