Abstract

The extension of environmental regulation to previously unregulated areas of agriculture has led to a critical and controversial juncture. The immunity of nonpoint source pollution to mandatory regulation is being called into question by proposed regulations for impaired waters and concentrated animal feedlots. However, courts have been more inclined to place limits on EPA’s regulatory. Given the current climate, the fight over controversial regulation of impaired waters, wetlands, endangered species, concentrated animal feedlot operations, and nonpoint source pollution will be lengthy, divisive, and subject to political pressure. This article looks at controversy in several areas including the Endangered Species Act, Regulation of Pesticides and Herbicides, the Clean Water Act, CAFO’s, TMDL Programs, and Wetlands Regulation.
