Abstract

Portuguese Abstract: A Lei de Arbitragem Voluntária de Angola exige que os árbitros sejam não apenas independentes e imparciais mas também que evidenciem outras qualidades que dão substância aos princípios de deontologia dos árbitros. Se a confiança das partes nos árbitros é o princípio fundamental que deve perpassar qualquer arbitragem, a falta dela despoleta o mecanismo de recusa de árbitro. Imaginemos que num dado processo arbitral ambas as partes levantam sistematicamente a questão da recusa de árbitro; poderá, neste caso de sucessiva impugnação dos árbitros nomeados em substituição, invocar-se um abuso do exercício do direito de recusa de árbitro?

English Abstract: Angolan Voluntary Arbitration Law requires arbitrators to be independent and impartial, as well as to be able to show other qualities that put into evidence the deonthological principles applicable to arbitrators. Trust in arbitrators is the most fundamental principal that needs to be ensured in an arbitration, otherwise the lack of trust will lead the parties to refuse the arbitrators. Let's assume that in a given arbitration process both parties constantly refuse arbitrators; would it then be possible, when several substitute arbitrators are refused one after the other, to claim the abuse of the exercise of the right to refuse an arbitrator?
