Abstract

Not infrequently, legal approaches to fighting climate change and other forms of environmental degradation adopt a post hoc litigation approach. Taking a different tack is his essay, based on the author’s presentation at a 2008 session entitled La Qualité du climat et l’internalisation du droit “Climate Quality and the Internationalization of Law” at the Collège de France de Paris. The essay proposes an ex ante human security approach to tackling climate change, then cites developments in international and transnational law that support such an approach.
