Abstract
In their March 2015 Harvard Law Review Note, Messrs. Clement and Katyal conflate non-naturalized "citizen" with "natural born Citizen" to conclude that under Article II of the Constitution, Senators Marco Rubio and Ted Cruz are eligible to be President of the United States. Upon the framingera sources and law, I demonstrate this conclusion by Messrs. Clement and Katyal is intellectually dishonest and simply cannot stand. Neither Marco Rubio nor Ted Cruz are eligible to be President as neither are "natural born Citizens" as required by Article II.
