Abstract

תקציר בעברית: דרישת הקיבוע בחוק זכות יוצרים קובעת כי תנאי להגנה של זכויות יוצרים הוא שהיצירה תהיה מקובעת (כלומר מתועדת באמצעי כלשהו). מאמרו של ד"ר יואב מזא"ה בוחן את דרישת הקיבוע ואת ההצדקות לדרישה זו. הצדקות אלה כוללת את ההצדקה הראייתית, הסובייקטיבית (כלומר שיקוף עמדת היוצר ביחס ליצירה שלו), הציבורית (כלומר העשרת הציבור ביצירה עצמה). אולם עיון בהצדקות אלה מלמד כי אין התאמה ביניהן לבין דרישת הקיבוע כפי שהיא מנוסחת בחוק. כך לדוגמה, בחוק אין דרישה כי הקיבוע של היצירה יישמר, שהוא ייעשה על ידי היוצר או מטעמו, ו\או שהקיבוע יונגש לציבור. כך שמבוחנים את דרישת הקיבוע עולה כי ההצדקות המקובלות בהקשר לדרישה זו אינן מסוגלות להצדיק את דרישת הקיבוע כפי שהיא מנוסחת בחוק. המאמר מציע שינויים לדרישת הקיבוע על מנת לתקן פגמים אלה.

English Abstract: One of the significant amendments found in the Copyright Act, 2007 is the explicit and general requirement of fixation. According to the fixation requirement, to be protected by copyright it is not sufficient for a work to conform to the substantive criteria of copyright (such as originality), but it must also be fixed in some medium, that is, it needs to be written, recorded, etc. In this chapter Dr. Yoav Mazeh argues that the expansion of the fixation requirement in the Act is not justified. After considering the justifications for the fixation requirement, the author concludes that they fall short of justifying it in its current form. Further, the chapter argues that spontaneous authors and artists are worse off as a result of the expansion of the fixation requirement. In this light, the conclusion is that the fixation requirement is not justified, not only because the rationales underlying it are inadequate, but also because it encourages fixation on the part of the authors, as opposed to dynamic and spontaneous creativity.
