Abstract

This article criticizes two significant opinions of the Arizona Supreme Court on the general acceptance of random-match probabilities for DNA evidence. It shows that these opinions misuse scientific terms, misrepresent the simple product rule, and misread expert testimony in ways that affect the rules for admitting DNA evidence. It discusses procedures that might assist appellate courts and help produce opinions that present scientific information more accurately.
