Abstract

תקציר בעברית: מבין דוקטרינות השותפים לביצוע עבירה, דוקטרינת הביצוע בצוותא מעוררת את השאלה המשפטית-פילוסופית המשמעותית ביותר: מדוע מבצע בצוותא מורשע בביצוע העבירה העיקרית ועונשו כשל מבצע עיקרי הגם שהוא לא ביצע את מלוא הרכיב ההתנהגותי של העבירה? מאז תיקון 39 הפכה שאלה זו להיות משמעותית ביותר לנוכח ההבחנה הדרמטית שבין ענישת המסייע לענישת המבצע בצוותא, ולנוכח הכרסום שחל מאז התיקון בהטלת אחריות פלילית בגין סיוע לעבירה על חשבון הרחבה מקבילה בהטלת אחריות פלילית בגין ביצוע בצוותא.

כדי להרשיע אדם בביצוע בצוותא של עבירה ספציפית יש להוכיח קיומו של יסוד עובדתי ונפשי. הספרות המשפטית התמקדה בסוגיית היסוד העובדתי הנדרש לביצוע בצוותא ובעיקר בשאלת היחס שבין מבצע בצוותא לבין מסייע. בניגוד ליסוד העובדתי, היסוד הנפשי הנדרש לשם הטלת אחריות פלילית בביצוע בצוותא וכן הרציונלים העומדים בבסיס דוקטרינה זו טרם זכו להתייחסות מספקת. במסגרת המאמר מצביע המחבר על כך שהיסוד הנפשי הנדרש בביצוע בצוותא הוא מעורפל, וכי קיימת בפסיקה הישראלית חוסר אחידות ובהירות ביחס אליו. בנוסף מצביע המחבר על כך כי קיים חסר בפסיקה ובספרות באשר לרציונלים העומדים בבסיס הדוקטרינה של ביצוע בצוותא, רציונלים שאינם באים לידי ביטוי מפורש בעמדות השונות שהוצעו ביחס להבחנה שבין סיוע לביצוע בצוותא. לטענת המחבר הנהרת הרציונלים כאמור אמורה להשפיע לא רק על היסוד הנפשי הנדרש בביצוע בצוותא אלא אף בתחימת קו גבול נכון יותר בין הסיוע לביצוע בצוותא במישור הרכיב ההתנהגותי של דוקטרינה זו.

לאור האמור, בפרק א דן המחבר בדוקטרינה הכללית של ביצוע בצוותא תוך העלאת ביקורת באשר למבחנים שהוצעו להבחנה שבין סיוע לביצוע בצוותא. בפרק ב מצביע המחבר על חוסר האחידות הקיים בפסיקה ביחס ליסוד הנפשי הנדרש בביצוע בצוותא ובפרק ג מוצעים הרציונלים האפשריים העומדים לדעתו בבסיס הדוקטרינה של ביצוע בצוותא וכן מוצע יישומם במסגרת פסיקה עתידית. בפרק ד דן המחבר בהשפעת הרציונלים על הרכיב ההתנהגותי של ביצוע בצוותא תוך התייחסות ספציפית למתכנן העבירה, וכן להרחבה שחלה לאחרונה לדוקטרינת הביצוע בצוותא על חשבון השידול לעבירה.

English Abstract:Among the doctrines pertaining to persons involved in the commission of a crime, the doctrine of joint perpetration raises a significant philosophical-legal question: why is a joint perpetrator convicted of the actual crime and subject to the same penalty as the one who actually carries out the crime even though he lacks the requisite actus reus? In the wake of Amendment 39, this question has become more significant in light of the dramatic distinction drawn between the penalty for an accessory and the penalty for a joint perpetrator as well as the contraction in attribution of criminal responsibility to an accessory and the simultaneous expansion of attribution of criminal responsibility to a joint perpetrator.

In order to convict someone as a joint perpetrator of a specific crime, one must prove the existence of both a factual and mental basis. The legal literature has thus far focused primarily on the factual basis required for joint perpetration, particularly with regard to the balance between joint perpetration and aiding and abetting. However, the mens rea required to attribute criminal responsibility to a joint perpetrator, and the rationales that underpin this doctrine, have yet to be addressed sufficiently. In this article, the author points out that the mens rea required for joint perpetration is unclear and that Israeli case law to date demonstrates a lack of both consistency and clarity in this regard.

The author also indicates that both the case law and the literature fail to mention the rationales that support the doctrine of joint perpetration. Such rationales are not expressed directly in the various suggestions for how to distinguish between aiding and abetting and joint perpetration. An examination of these rationales may contribute not only to understanding the mens rea required for joint perpetration but to delineating the proper boundary between accessory and joint perpetrator with regard to the actus reus as well.

Chapter I discusses the general doctrine of joint perpetration and critiques the tests thus far proposed for distinguishing between accessory and joint perpetrator. Chapter II demonstrates the existing inconsistency in case law with regard to the mens rea required to prove joint perpetration. Chapter III presents the possible rationales behind the doctrine of joint perpetration and how these would play out in future cases. Chapter IV examines the influence of the rationales on the actus reus element of joint perpetration, with specific focus on the party who instigates a crime as well as on the recent expansion of the doctrine of joint perpetration vis-à-vis enticement to commit a crime.
