Abstract

These slides cover the 7 most important aspects of employment security. They begin with coverage of what it means to be an employee at will and evaluate valid reasons for terminations. They then move to exceptions to the employment at will doctrine such as public policy, implied contract and good faith & fair dealing. The discussion then turns to the torts employers may have along with a wrongful discharge case. Finally the slides move to contract employees and the most common clauses that are found in employment contracts such as non-competes, non-disclosures and arbitration clauses. The slides conclude with a list of employee duties such as the duty of loyalty and the duty of care as we as some tough questions about this important area of the law.
