Abstract

Spanish Abstract: El derecho español de daños es un derecho conocido y aplicado por varias jurisdicciones potencialmente competentes. La atribución de asuntos se efectúa de acuerdo con criterios establecidos legalmente o conforme a convenciones jurisprudenciales. En todo caso, la atribución de competencia de jurisdicción tiene en cuenta el régimen legal que resulta de aplicación al demandado, potencial responsable del daño. De este modo, se había resuelto por la Sala Primera del Tribunal Supremo la controversia que había existido históricamente entre la Sala Civil y la Sala Social del Tribunal Supremo en relación con la competencia para declarar la responsabilidad del empresario por daños sufridos por sus trabajadores como consecuencia de un accidente de trabajo o de una enfermedad profesional. Siempre que la demanda invocara el incumplimiento de normas laborales de seguridad y prevención, la competencia debía corresponder a la jurisdicción social. El criterio, sin embargo, no preveía de qué modo debía adjudicarse la competencia de jurisdicción cuando terceros ajenos a la relación laboral y trabajadores afectados demandaran conjuntamente a un empresario. La STS, 1ª, 3.12.2015 ha tenido que resolver un caso en el que así ha sucedido y que involucró a varias víctimas del amianto.

English Abstract: The Spanish law of torts is applied by several specialized courts. The criteria according to which a specific case is solved by any of those courts depend on the specific legal regime applicable to the tortfeasor. Hence, the Spanish Supreme Court provided many years ago that in any case in which the labor regulations were involved, the Labor Courts should be deemed as able to decide. However, such a way for solving the attribution problem attached to the existence of several specialized courts did not foresee the case in which the plaintiffs were partially workers or former workers and partially third persons alien to the labor relationship. In the decision rendered by the Private Law Cahmber of the Spanish Supreme Court on December 3, 2015, the concurrence of workers and non-workers plaintiffs did not allow the Private Law Chamber to derive the case entirely to the Labour Courts, but only for those plaintiffs that worked or actually work for the defendant.
