Abstract

Italian Abstract: Le ragioni giuridiche di un modello di nuova generazione di capitolo sociale, da poter con- siderare utile per la negoziazione del Ttip, sono presentate nel saggio, anche alla luce delle negoziazioni tra Europa e Stati Uniti di questi ultimi mesi. Sono approfonditi i temi re- lativi alla giustizia arbitrale tra Stato e impresa multinazionale, nell’ambito di possibili clausole di non regresso, clausole Isds e assetto di tutele di cui al Trattato di Lisbona. Vengono altresì analizzati gli aspetti che riguardano i documenti di negoziazione che stan- no alla base del Ttip, con l’intento di far emergere le potenzialità di tale documento con ri- guardo alle tutele del diritto del lavoro e della previdenza sociale.

English Abstract: The Labor Chapter of the TTIP (Transatlantic Trade and Investment Partnership Agreement) may shape forthcoming vision of labor and industrial relations in the EU in the USA. Here a new generation of labor chapters in investment/partnership treaties is analyzed, considering that the TTIP may be turned into an opportunity for the forthcoming mega-treaties. This research proposes a critical legal approach dealing with some questions: why, to what extent and how the TTIP labor chapter may be set up. A special focus on the TTIP and ISDS in labor items is included. Documents and materials relate to the recent negotiation are studied, with a labor and social security protection approach.
