Critically Analyse: The Laws Relating to Hijacking

Abstract

Hijacking is a crime which is domestic and international. It is a crime where only the life of the captives is not the only issue, but, countries’ sovereignty is also at stack on some cases. The world’s community is zealous to address this issue in a strict way so that this crime can be eliminated. There are different laws to address this crime at domestic level. However, at International level, there are three conventions i.e. Tokyo 1963, Hague 1970 and Montreal 1971. In this paper these three conventions are explained briefly. The duties of the states who have signed this convention are elaborated. History of hijacking and the motives behind hijacking is explained. Powers of the commander of an air craft are enlighten under these conventions. A critical analysis is given in this paper which describes the loopholes of the conventions. Finally, a way forward is suggested to address this issue in more efficient way.
