Sobre los comentarios del Poder Ejecutivo a sentencias judiciales en Chile (On the Executive Power Comments to Judicial Decisions)

Abstract

Spanish Abstract: El presente trabajo busca analizar la presunta prohibición constitucional que tiene el Poder Ejecutivo para comentar sentencias judiciales. El análisis del artículo 76 de la Constitución, en su origen histórico, no da muestras de una prohibición a criticar o comentar resoluciones de los Tribunales de Justicia, pero sí para sustituir la jurisdicción de dicho órgano del Estado. Sin embargo, se han planteado distintas interpretaciones finalistas sobre el tema por parte de destacados profesores, ex ministros de Estado y ex ministros del Tribunal Constitucional que son interesantes de analizar para dilucidar si existe realmente una prohibición al Poder Ejecutivo de comentar o criticar el actuar del Poder Judicial.

English Abstract: This paper analyzes the alleged constitutional prohibition of the executive power to comment rulings of the Judiciary. The analysis of Article 76 of the Constitution, given its historical origin, shows no sign of a prohibition to criticize or comment on rulings of the Courts of Justice, but to substitute the jurisdiction of these tribunals. However, several finalists interpretations on the subject have been raised concerns by prominent professors and former justices of the Constitutional Court that are interesting to analyze, in order to determine whether there really is a ban on the Executive Branch to comment or criticize the actions of the Judiciary.
