Abstract

This chapter aims to impart to the reader an understanding of the law regulating the contract of insurance. It defines insurance (indemnity and non-indemnity) and distinguishes insurance contracts from wagers and suretyships. The formation and content, breach and termination of the contracts of insurance; the doctrines of contribution and subrogation and the duties of good faith and disclosure are discussed in this chapter. the impact of the South African National Credit Act and the Consumer Protection Acts on insurance are also considered.
