Abstract

The emergency arbitration process is described with specific reference to the salient arbitration rules of the American Arbitration Association and the International Centre for Dispute Resolution (ICDR) and supplemented by the author's experience in having conducted an actual emergency ICDR arbitral proceeding. Applicable US legal precedent is also discussed. The actual arbitral award, as published by the respondent involved in that proceeding, is provided in Appendix A.
