Abstract

Spanish Abstract: El siguiente trabajo tiene como propósito examinar la Ley de Menores de Puerto Rico (1986) y su Reglamento de Procedimientos mediante el lente de la Justicia Terapéutica. Para dicho examen se tomará la analogía de “Vinos & Botellas” para identificar aquellas áreas de la ley que son anti-terapéuticas y de qué forma se podrían mejorar con la colaboración de la Justicia Terapéutica. Este trabajo en particular se enfocará en la implementación de medidas correctivas con los menores. Estas son desde la implantación de los programas de Desvío hasta las condiciones en las otras medidas dispositivas disponibles para intervenir con un menor. A través de la Justicia Terapéutica, se analizará el impacto de estás medidas y se harán recomendaciones que garanticen el resultado deseado, en el caso de los menores, su rehabilitación integral.

English Abstract: This paper examines the Juvenile Act of Puerto Rico (1986) and its Rules of Procedure through the lens of Therapeutic Jurisprudence. For this analysis, the analogy of "Wines & Bottles " will be used in order to identify those areas of the law that are anti-therapeutic and how they could be improved with the help of Therapeutic Jurisprudence. This particular article will focus on the implementation of corrective measures to juveniles. The analysis will take into account the implementation of diversion programs and also the conditions in the other corrective measures available in juvenile proceedings to intervene with a minor. The aim of TJ-Friendly techniques will be taken into consideration when examining this legislation in order to share some therapeutic recommendations of how these proceedings might be held in a more therapeutic way to guarantee the rehabilitation of the minors.
