Legal Barriers and Other Challenges to Franchising in Cuba

Abstract

Franchising in Cuba, as in other frontier markets, is fraught with challenges. Before beginning, prudent franchisors should engage experienced attorneys on both sides of the equation, at home and in Cuba. One can expect to encounter many of the same issues frequently found in any international franchising operation, such as issues with intellectual property protection, dispute resolution, remittance of royalties, and complications with marketing efforts and franchisee training arising from cultural differences. Challenges such as these, however, have been resolved in similar markets. This paper explores the challenges and obstacles one may encounter in a franchising pursuit in Cuba.
