Abstract
In Fletcher v. The Dakota the court reconsidered when board members of cooperative corporations will be individually liable for discriminatory actions of the board. Specifically, the court explored whether an independent tortious acts requirement should be employed. This article analyzes the court’s decision in Fletcher in light of existing case law regarding individual liability for tortious conduct, violations of the Fair Housing Act, and employment discrimination.
