اتانازی: مشروع یا غیرقانونی؟ بررسی تطبیقی اتانازی در حقوق ایران و هلند (Euthanasia: Legitimate or Illegal? A Comparative Review of Euthanasia Under Iranian and Dutch Laws)

Abstract

Persian Abstract: اتانازی به بیمار فرصت می دهد که بدون تحمل درد و رنج مداوم از ادامه زندگی انصراف دهد. اینکه اتانازی را از نگاه قانون ایران و منطبق با نظام حقوقی و مذهبی ایران مجوز قتل بدانیم، یا خودکشی، یا معاونت در جرم، یا هیچکدام موضوعی است که باید بعدها بدان پرداخت. آنچه قابل تامل است آنکه در حال حاضر یک ایرانی می تواند با اقامت در قلمرو سرزمینی که اتانازی را طبق شرایطی مجاز می داند، مشمول اتانازی شود. مسلم است علیرغم اینکه در قانون ایران جایگاهی برای خودکشی مشخص نشده، آمار خودکشی به قصد پایان دادن به تألم روحی و جسمی کم نیست. ارزیابی امکان در مسیر قانونی و شرعی انداختن برخی موارد، که در آن پزشک ضرورت اعمال اتانازی را تشخیص دهد؛ موضوعی نیست که بتوان به صورت انتزاعی و بدون در نظر گرفتن شرع و عرف جامعه و ضرورتهای پزشکی مورد بررسی قرار داد.

در این مقاله اتانازی صرفا مورد بررسی تطبیقی قرار گرفته است. هدف این نوشتار پرداختن به بایدها و نبایدها نیست، بلکه جایگاه حقوقی اتانازی در حقوق ایران و هلند مورد مداقه قرار می گیرد. ادامه بحث، در صورت ضرورت، به محافل و بخشهای تخصصی تر واگذار می شود.

English Abstract: Euthanasia is the practice of terminating the life of a patient so as to relieve them from incurable suffering. The issue whether to consider euthanasia, under Iranian law and in conformity with Iranian legal system and religion, be considered as a permission to kill, or suicide, aiding and abetting a crime, or none of the above, must be addressed elsewhere at another time. What is noteworthy, however, is the fact that an Iranian individual can at present submit to this practice simply by taking up residence in any country in which euthanasia is, under certain conditions, legally permitted. A review of Iranian laws reveals that euthanasia has not been regulated yet. Still, in the absence of any rule, formal and informal statistics indicate that tendency to terminate life for the purpose of putting an end of physical and mental pain is not so low as to justify complacency. Assessment of legalization and legitimizing of the practice in appropriate cases is a task which should not be undertaken in abstract, and without taking into consideration religion, custom, and medical requirements in an Islamic country.

This article examines euthanasia from a comparative perspective. The aim is not to suggest what should or should not be done. It is, rather, to review the legal position of euthanasia under Iranian and Dutch laws. Further specialized treatment of the issue, if necessary, is best left to the professional and specialized agencies and experts in the field.
