Abstract

תקציר בעברית: תחומי התכנון והחקיקה במדינת ישראל עדיין לוקים בחסר כשהדבר נוגע לשטחים הימיים שלה בים התיכון. בים העמוק, ובפרט באזור הכלכלי הבלעדי (המים הכלכליים) של ישראל – שנמצאו בהם תגליות הגז הטבעי הגדולות ביותר – מחסור זה ניכר במיוחד. המאמר הנוכחי מתייחס לשני תהליכים מקבילים, האחד של מִנהל התכנון והאחר של הטכניון, שמטרתם המוצהרת לספק מסמך מדיניות ותכנית מרחבית לאזורים הימיים של ישראל בים התיכון. בעלי עניין שהשתתפו בכל אחד משני התהליכים התבקשו למלא משוב מפורט. המאמר מציג את התובנות הנובעות מניתוח המשוב באשר לשימושים הקיימים והעתידיים בים התיכון, וכן לערכים, לצרכים ולקונפליקטים באזור ימי זה וליחסי הגומלין ביניהם.

לצד הנושאים שהעלו בעלי העניין בהתייחס למגזרים השונים (לפי המגזר שהם מייצגים, לדוגמה מגזר האנרגיה), ניתוח המשוב העלה כמה תֵמות על-מגזריות. ראשית, ממצאי הניתוח מעידים על מתח בין אינטרסים של שימור לבין אינטרסים של פיתוח. שנית, ממצאים אלה מסייעים בהדגשת המאפיינים הייחודיים לאזורים הימיים של ישראל בים התיכון. בכלל זה ניתן להבחין בהתייחסות מועטה (יחסית לתהליכים מקבילים בעולם) להפקת אנרגיה מתחדשת ולדיג (הזוכה להתייחסות בעיקר בהקשר הסביבתי), לצד התייחסות רבה לשיקולים גאו-אסטרטגיים. שלישית, הניתוח העלה מגמה של בעייתיות על-מגזרית בתחומים של משילות, תכנון ואכיפה, המאופיינת בתחושה של עמימות חוקית ותכנונית, שהוצגו במשובים כפוגעים בתפקוד גורמי ממשל ואכיפה ובמאמצי ההגנה והשיקום של הסביבה הימית באזור זה. העובדה שגם נציגי המגזר העסקי-היזמי הציגו עמדות דומות בהקשר זה, בשל הצורך בהצגת ודאות מול משקיעים, מראה כי מדובר באינטרס משותף לבהירות .חוקית רבה יותר, הנוגע לרוב המכריע של בעלי העניין, ולפיכך גם לישראל עצמה

English Abstract: Stakeholder feedback can be particularly valuable when marine data and information are insufficient, or when marine planning and legislation are unclear or deficient. Two parallel marine spatial planning (MSP) processes, one led by the Israel Planning Authority (IPA) and one led by the Technion University, have recently been initiated, and the initial feedback of the participating stakeholders was analyzed for the purposes of the current study. Currently, Israel lacks a clear planning and regulatory framework for the management, exploitation and protection of the Mediterranean Sea. In Israel’s deep sea this deficiency is particularly ctitical, expecially in its Exclusive Economic Zone (EEZ) – where significant natural gas discoveries were made in the past 20 years. The analysis reveals an expected tension between interests of preservation and those of development indicated that most sectors (public and private) see deficiencies pertaining to governance, planning and enforcement as detrimental to their sector. This analysis also highlights the unique characteristics of the Israeli Mediterranean Sea, including relatively little interest in developing renewable offshore energy and in fishing, while security considerations are of relatively great importance.
