The Diffusion of Precedent across the American States

Abstract

I propose a network theory of precedent that emphasizes the social interaction — the citations — as a key influence on the development of the law. I address the question of why state high courts look outside their jurisdictional borders by applying a statistical model of network connections (an ERGM).
