Abstract

English Abstract: The European Court of Human Rights was often confronted with an impressive number of applications called repetitive applications. These applications targeting violations of a right under the Convention originated in a systemic or structural failure internally. In such a situation, the ECHR .According to Article 61 of the Rules of Court, there are suspended the cases following to rule in one or several combined causes, indicating the outcome of the measures which the High Contracting Party shall adopt as legislative plan and otherwise this one being exposed to penalties that may go up to exclusion from the Council of Europe.

Romanian Abstract: Curtea Europeană a Drepturilor Omului a fost confruntată adesea cu un număr impresionant de cereri numite şi cereri repetitive. Aceste cereri care vizează încălcări ale unui drept prevăzut de Convenţie îşi au originea într-o disfuncţionalitate sistemică sau structurală la nivel intern. Într-o atare situaţie, C.E.D.O .potrivit articolului 61 din Regulamentul Curţii, suspendă cauzele urmând să se pronunţe într-una sau mai multe cauze reunite, indicând prin soluţia pronunţată, măsurile pe care Înalta Parte Contractantă trebuie să le adopte în plan legislativ, iar în caz contrar aceasta expunându-se unor sancţiuni care pot merge până la excluderea din Consiliul Europei.
